Harvey Weinstein, 72, was appealing his conviction for sexually assaulting the actress in a Los Angeles hotel room more than a decade ago. Weinstein’s lawyers filed the appeal with the 2nd District Court of Appeals on Friday, a year after indicating their intention to seek a new trial in the case in Los Angeles in 2022.
The model and actress is one of four women involved in the lawsuit against Weinstein, who was found guilty of sexual assault in a Los Angeles courtroom in February 2023 and sentenced to 16 years in prison. Weinstein’s legal team has received multiple postponements from the court over the past year to give them more time to prepare documents.

Weinstein was convicted in December 2022 of forcible rape, forcible oral copulation and penetration of a foreign object by a woman identified only as Jane Doe 1 in February 2013. A jury at the time was unable to reach a unanimous verdict on three other charges, including one related to California Gov. Gavin Newsom’s wife, filmmaker Jennifer Siebel Newsom.

A jury found Weinstein not guilty of a felony charge of sexual assault by restraint for his alleged 2010 attack on masseuse Jane Doe 3, but was unable to reach a verdict on a lesser charge against the same woman.
The judge noted that no misdemeanor charges have been filed, and prosecutors said in December they would not pursue an investigation involving the alleged victim.
Prosecutors later said they would not retry Weinstein on the charges on which the jury disagreed. Weinstein was sentenced to 16 years in prison.

In appealing his conviction, Weinstein is hoping for a similar outcome to the one he received in New York state, where an appeals court in April overturned his rape conviction there. He was convicted and sentenced to 23 years in prison. New York prosecutors are expected to retry the case.
